These Terms of Use (TOU) shall apply to (a) all websites owned and/or operated by MICEapps, including without limitation all webpages, subdomains and subparts therein contained, as well as mobile apps (b) any and all application modules available on or through theSite. All Modules are owned and operated by MICEapps. Modules are offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies and procedures that may be published from time to time on the Site by MICEapps.
In the event of a conflict between these Terms of Use and the Additional Terms for a conference, event, license, class, ticket, contest, permit, facility/equipment reservation, transaction, sale, membership, reservation, donation, and/or activity for which you are using the Site to register or purchase (each, an “Event”), the Terms of Use shall govern. These Terms of Use will remain in full force and effect as long as you are a user of the Site and in the event of termination of any membership, service or feature, you will still be bound by your obligations under these Terms of Use, including any indemnification obligations, warranties, and limitations of liability.
By using or attempting to use the Site, you certify that you are at least 18 years of age or, if under the age of 18, your parent has consented to your use of the Site. You also certify that you are not a person barred from usage of the Site under the laws of Singapore or any other applicable jurisdiction. If you do not meet these requirements or, if for any reason, you do not agree with all of the terms and conditions contained in these Terms of Use, or all other operating rules, policies and procedures that may be published from time to time on the Site by MICEapps, you must stop using the Site immediately.
The English language version of each of these documents is the version that governs your use of the Site and in the event of any conflict between the English language version and a translated version, the English language version will control. A printed version of these Terms of Use and of any notices given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms of Use to the same extent and subject to the same conditions as other business documents and records originally generated and maintained inprinted form.
MICEapps reserves the right, at its sole discretion, to modify or replace any of the terms or conditions of this TOU at any time. It is your responsibility to check this TOU periodically for changes. Your continued use of the Site following the posting of any changes to this TOU constitutes acceptance of those changes. If any change to this TOU is not acceptable to you, your sole remedy is to cease accessing, browsing and otherwise using the Site.
Meetings, Incentives, Conferencing, Exhibitions Applications (MICEapps) allows you to engage with the MICE community via seamless application modules to improved pre event, onsite and post event efficiency and accuracy. It helps event organisers and planners ("Organisers") enhance the overall experience of buyers and exhibitors (conference & leisure). The end-to-end data collection and MICEbigdata analysis aims to benefit all stakeholders in the MICE industry.
The one-stop-shop MICEapps provides a simple and quick means for Organisers to collect payments with respect to the sale of MICE tickets/registrations, merchandise and Modules and the solicitation of donations with respect to events registered on the Site from users who are interested in such events. Organisers will use the Site to fill in a questionnaire about their event, including information such as the venue, pricing, discount codes, etc., and collect event registration fees online directly from Buyers. Payments are all transacted through PayPal, Wordplay, Authorize.net or other third party payment service methods (collectively, "Facilitated Payment Modes" or "FPM"). Alternatively, Organisers may choose to use the MICEapps payment processing gateway (the "Gateway"), which allows for Telegraphic Transfers (TT), Local Cheques and Onsite Cash Collection.
If you are allowed to download or use any Module, MICEapps hereby grants you a personal, non-transferable, non-sublicensable, revocable, non-exclusive licence to use the Modules solely for your internal use and only in accordance with this TOU, the terms and conditions of each separate Module, and the written instructions/directions (if any) provided by MICEapps in conjunction with the Modules.
Downloading or using the Modules is at your sole risk. You shall also be responsible for using the Modules in a manner that complies with all federal, Singapore local laws and the rules and regulations of all credit card companies.
The Module and related documentation are "commercial computer applications" and "commercial computer applications documentation," respectively, as such terms are used in Singapore Federal Acquisition Regulations. Any use, duplication or disclosure of the applications or such documentation by or on behalf of the SG. Government is subject to restrictions as set forth in this TOU.
If you wish to purchase credit points or register for an Event described on the Site (each, a “Transaction”), you will be asked to supply certain information applicable to your Transaction, including, without limitation, credit card and other information. You understand that any such information will be treated by MICEapps in the manner described in our Privacy Policy. You agree to pay all charges incurred by you or any users of your account and credit card (or other applicable payment mechanism) at the price(s) in effect when such charges are incurred. You will also be responsible for paying any applicable taxes relating to your Transactions. In addition to these Terms of Use, your Transaction shall be subject to any Additional Terms applicable to such Modules, features or purchases. Registration for Events may be regulated by certain state, county and city laws or regulations.
You acknowledge that complying with laws is your responsibility, and you agree not to hold us liable for your failure to comply with any law or our failure tonotify you of, or properly apply, any law. We will comply with law enforcement and may provide them with all information you submit to us to assist in any investigation or prosecution they may conduct. You represent and warrant that all information you provide, including but not limited to all information concerning your name, address, credit card number, and other identifying information of any nature will be true, complete and correct, and that you will update all information as it changes. You agree that you will only use credit cards belonging to you or for which you are expressly authorized to use. You further agree that you will not attempt to conceal your identity by using multiple Internet Protocol (“IP”) addresses or email addresses. You grant MICEapps the right to provide any information you submit to third parties for purposes of facilitating the completion of Transactions initiated by you or on your behalf. Verification of information may be required prior to the acknowledgment or completion of any Transaction.
To be a registered user of the Modules, whether as a Buyer or other non-Organiser, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Site registration form (the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or MICEapps has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, MICEapps has the right to suspend or terminate all of your accounts and refuse any and all of your current or future use of the Modules (or any portion thereof). MICEapps is concerned about the safety and privacy of all its users, particularly children. For this reason, and to be consistentwith the terms of use of any payment service provider or other third party service provider, you must be at least 18 years of age, or the legal age ofmajority where you reside if that jurisdiction has an older age of majority, to register for an account.
No refunds will be allowed once credit points have been purchased by the Organiser. It is the responsibility of the Organiser to communicate its refund policy to Buyers and to issue refunds to Buyers via the Site or otherwise. To request for a refund, the Buyer must approach the Organiser directly. All communications or disputes regarding refunds are between the Organiser and Buyer. MICEapps will not be responsible or liable in any way for refunds, including all communications, disputes, errors, or lack of refunds in connection with the Modules.
MICEapps reserves the right at any time to, and from time to time may, modify, suspend or discontinue, temporarily or permanently, the Modules (or any part thereof) for any reason or no reason with or without notice. You agree that MICEappsshall not be liable to you or to any third party for any modification, suspension or discontinuance of the Modules.
MICEapps, at its sole discretion, may terminate your accounts (or any part thereof) and/or your right to use the Modules, and remove and discard any and all ofYour Content within the Modules, at any time for any reason or no reason, including, without limitation, for lack of use, failure to timely pay any credit or other monies due to MICEapps, or if MICEapps believes that you have violated or acted inconsistently with the letter or spirit of this TOU.
The Modules may provide, or third parties may provide, links to other Internet websites or resources. Because MICEapps has no control over such websites and resources, you acknowledge and agree that MICEapps is not responsible for the availability of such websites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, Modules or other materials on or available from such websites or resources. You further acknowledge and agree that MICEapps shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with any use of or reliance on any such Content, advertising, products, Modules or other materials available on or through any such websites or resources.
THE MODULES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. MICEapps HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE.
MICEapps SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES OR UNDER ANY LEGAL THEORY, WHETHER IN TORT, CONTRACT, OR OTHERWISE, WITH RESPECT TO THE MODULES, OR ANY OTHER SUBJECT MATTER OF THIS TOU.
IN CONSIDERATION OF BEING PERMITTED TO ACCESS AND USE THE MODULES, YOU HEREBY AGREE TO RELEASE MICEapps.
All information provided by you or collected by MICEapps in connection with the Modules is governed by MICEapps' Privacy Policy, which is hereby incorporated by reference into this TOU. MICEapps strongly recommends that you review the Privacy Policy closely.
Notices to you may be made via either email or regular mail to the address in MICEapps' records. The Modules may also provide notices of changes to this TOU or other matters by displaying notices or links to notices to you generally on the Modules. Any notice from you to us shall be sent in writing to our mailing address at MICEapps, 2 Leng Kee Road, #03-02, Thye Hong Centre Singapore 159086. Attn: MICEapps.
